Legal Agreement for Marte Services

Effective Date: March 2025

Welcome to Marte, operated by Marte Holdings INC. By accessing or using our services (including our website, API, and related products), you agree to these Terms of Service (“Terms”). If you disagree, please do not use Marte.

1. Services Provided

Marte provides access to advanced language models via an API featuring enhanced privacy protections, including detection and safeguarding of personally identifiable information (PII). We offer multiple privacy settings and usage tiers tailored to diverse user requirements.

2. Account and API Security

You must maintain the confidentiality and security of your API keys. You are fully responsible for all activities conducted through your account or using your API keys. Immediately notify us at security@marte.app of any unauthorized access or suspicious activity.

3. Acceptable Use

You agree not to use Marte to:

• Generate or disseminate unlawful, abusive, harmful, or deceptive content
• Violate intellectual property rights or privacy rights of any third party
• Reverse-engineer, disrupt, or attempt unauthorized access to our systems
• Engage in activities violating applicable laws and regulations

We reserve the right to suspend or terminate your access without notice for violations or abuse.

4. Privacy and Data Handling

Marte provides varying privacy protection levels. Higher privacy levels include stricter handling of sensitive information. However, you remain solely responsible for complying with all applicable data protection laws.

No Data Training: Marte does not use your inputs or outputs to train or improve our models. Inputs are processed solely for the purpose of generating outputs.

5. Billing and Payments

Fees are charged based on your selected subscription plan and usage tiers. All fees are non-refundable unless required by law. Marte may adjust pricing with at least 30 days’ prior notice.

6. Intellectual Property

You retain ownership of your input data and generated outputs. Marte retains ownership of its models, software, technology, and infrastructure.

7. Service Availability

Marte strives to provide reliable and uninterrupted service but does not guarantee constant availability. Features, functionalities, or availability may change at our discretion, with or without notice.

8. Disclaimers and Limitation of Liability

Marte services are provided “as is,” without warranties or conditions of any kind, express or implied. To the maximum extent permitted by applicable law, Marte shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of Marte services.

Marte’s total liability shall not exceed the amount you paid for our services in the six months preceding any claim.

9. Modifications to Terms

We may update these Terms occasionally. Your continued use of Marte following such updates indicates your acceptance of the revised Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Mexico, without regard to conflict of law provisions. Any disputes shall be resolved under the exclusive jurisdiction of the courts in Mexico City, Mexico.
